Legalization or Certification of Documents with the Apostille?

About submission of an application

An application of marriage can be submitted in Tallinn, Pärnu road 67, irrespective of the residence of the prospective spouses.

For the submission of an application (and contraction of marriage) it is required both of the prospective spouses being present in person at the same time, Pärnu road 67, room 103.  The form can be filled at Tallinn Vital Statistics Department. Identity document is required.  

The people who have been in marriage earlier have to deliver the document about the ending of marriage. (Death Certificate, Divorce Certificate.)

If the divorce document has given by the member of EU country which has made after 01.03.2005 then it is necessary to add to this document the reference which has enacted in the EU statute 2201/2003EU (ANNEX I). Adding the reference will assure that the verdict is formally entered into force.

The verdict decision of EU member country which has made before the 01.03.2005 have to be certificated with the apostille and another countries verdict decision have to be certificated with the apostille or has to be legalized.

How soon is it possible to get married?

According to the Family Law Act § 1 a marriage shall be contracted not earlier than one month and not later than three months after submission of an application to a vital statistics office by the prospective spouses.

How much does it cost?

The State Fee is 300 crowns

Plus:
Ceremony on Wednesday 360 crowns (incl vat 20% 60 crowns)
Ceremony on Thursday 600 crowns (incl vat 20% 100 crowns)
Ceremony on Friday 1200 crowns (incl vat 20% 200 crowns)
Ceremony on Saturday 1200 crowns (incl vat 20% 200 crowns)

It is also possible to have the ceremony outside of the accommodations of the Tallinn Vital Statistics
Department at the place chosen by You.

In Tallinn: 4200 crowns (incl vat 20% 700 crowns)
Outside of Tallinn in Harjumaa: 6150 crowns (incl vat 20% 1025 crowns)
Outside of Harjumaa: 10200 crowns (incl vat 20% 1700 crowns)

... can be served Your guests at the Banquet Hall of the Tallinn Vital Statistics Departement. The cost of the
rental of the Banquet Hall is 960 crowns (incl vat 20% 160 crowns) per hour.

Choice of surname

Upon contraction of marriage:

• both spouses retain their pre-marital surnames;
• spouses shall choose the surname of one spouse as the common surname;
• the surname of the other spouse is added to the spouse’s pre-marital surname.

When adding to the spouse`s pre-marital surname (for example Anderson-Kask) the hyphen is required.

Age of marriage

A person who has attained eighteen years of age is of age to marry. A minor between fifteen and eighteen years
of age may marry with the written consent of his or her parents or guardian. The written consent is required
regardless the divorce of the parents.

When the prospective spouse is a foreigner

When the prospective spouse is a foreign country citizen who has no residence permit he/she has to adduce a
certificate of the absence of circumstances hindering marriage from the country of residence. This certificate has
to be legalized or certificated with the apostille.When he/she has  a valid residence permit there is no need for
additional documents.

Marrying a foreigner in outside of Estonia

If the marriage is performed outside of Estonia, You can get the certificate of the absence of circumstances hindering marriage from vital statistics office. To get this certificate you must come to Tallinn Vital Statistics Department, identity document is required. The State Fee of certificate is 25 crowns.

How to legalize the foreign marriage in Estonia?

To legalize marriage which is performed outside of Estonia, the certificate of marriage must be legalized by the respective foreign country or have the certification (apostille) affixed to it.

Legalization or Certification of Documents with the Apostille?

Documents coming from foreign countries intended for use in Estonia must be legalized. But when the country
being party of the Hague Convention Abolishing the Requirement of Legalization for Foreign Public Documents the
document must be certified with the apostille.

For all the countries mentioned above documents must have the certification (apostille) affixed to them by a competent authority in Estonia and all documents coming from those countries into use in Estonia must have the certification (apostille) affixed to them in the respective foreign countries.

NB! Pay attention to the fact that the certification (apostille) is affixed to original documents, translations may be added optionally. In case you wish to use the copy of an original document in a foreign country the copy must be made of the original document, which has the certification (apostille) on it.

When there is an legal aid contract between Estonia and the foreign country, the further certification of the document is not necessary. Estonia has Legal Aid Agreements with:

NB! Foreign documents must be translated into estonian and the translation must be verified by notary.
