Tallinn Strategic Management Office Statutes

The statutes are enforced pursuant to clause 22 (1) 34) of the Local Government Organisation Act and subsections 52 (2) and (7) of the Statutes of Tallinn.

 

Chapter 1

GENERAL PROVISIONS

§ 1. Tallinn Strategic Management Office

(1) Tallinna Strateegiakeskus (hereinafter the strategic management office) is an institution of Tallinn.

(2) The official translation of Strateegiakeskus is:

1) In English: Tallinn Strategic Management Office;

2) In Russian: Центр стратегического управления Таллинна.

§ 2. Location

The strategic management office is located in Tallinn. The postal addresses of the strategic management office will be published on the Tallinn city (hereinafter also the city) webpage.

§ 3. Symbols

The strategic management office has its own stamp depicting the large coat of arms of Tallinn city and its own name, and blank legislative document forms and blank document forms with the city logo. A structural unit may have a logo that is based on the uniform visual identity of the city.

§ 4. Budget means

The expenses necessary for performing the tasks and the income from the activities of the strategic management office shall be planned in the city budget.

§ 5. Formation, reorganisation and termination of activities and reporting duty

(1) The strategic management office is formed and reorganised, its activities are terminated, and the statutes are confirmed and amended by the Tallinn City Council (hereinafter the council) with the proposal of Tallinn City Government (hereinafter the city government).

(2) The strategic management office has the duty to report to the city government, which leads and coordinates its activities and performs official supervision over it following the order provided in the law.

 

Chapter 2

GENERAL INFORMATION AND STRUCTURE

§ 6. Aim and main tasks of the activities of the Tallinn Strategic Management Office

(1) the main aim of the strategic management office is to coordinate the execution of the strategic aims of the city and to support the city government in creating a modern urban space for the citizens of Tallinn,

in performing public tasks, organising local life and forming relevant policies.

(2) The Tallinn Strategic Management Office acts as the competency centre for support services that supports the main activities of the offices and institutions administrated by the city.

(3) The Tallinn Strategic Management Office’s main tasks are:

1) organisation of development of the developmental and strategic aims of the city and supervision of their execution;

2) management of execution of major city projects and the implementation of city government policies in city institutions;

3) provision of public city services (incl. e-services) and support services and central management of the development of the respective principles and standards;

4) organisation of the activities of institutions administrated by the strategic management office.

(4) The strategic management office shall have the right to provide services in its domain to a legal person governed by private law with city’s shareholding pursuant to a contract signed with the said person.

§ 7. Tasks in strategic planning

The strategic management office performs the following tasks in strategic planning:

1) prepares the city development strategy and other city development documents, curates the preparation of city development documents and monitors their execution;

2) organises the preparation of general and thematic planning and city space visions and designs the Tallinn spatial development principles for this purpose;

3) participates in the processing procedures of projects and planning with significant spatial impact;

4) organises spatial, sociological and other surveys, analyses and idea raises and polls;

5) develops innovative solutions that provide competitive advantage for the city and manages their implementation;

6) participates in projects with cross-city importance and curates the execution of raising foreign funds and foreign projects;

7) organises representation of the city in international communication and ensures the following of related protocols;

8) designs city services and establishes service standards.

§ 8. Tasks in the field of entrepreneurship

The strategic management office performs the following tasks in the domain of entrepreneurship:

1) establishes developmental prerequisites for entrepreneurship;

2) markets Tallinn as a location for leisure, conference and business tourism;

3) organises Tallinn waste management and promotes circular economy;

4) acts as the advertising tax authority;

5) instructs, consults and conducts supervision and solves complaints in the domain of consumer protection;

6) organises the city’s participation in legal persons governed by private law;

7) conducts supervision and issues precepts within its competence and implements coercive measures or sanctions according to the General Part of the Economic Activities Code Act, Law Enforcement Act,

Penal Code, Alcohol Act, Tobacco Act, Trading Act, Packaging Act, Consumer Protection Act, Tourism Act, Precious Metal Articles Act,

Advertising Act, Taxation Act, Waste Act and other legislation and implements the general and special measures of state supervision.

§ 9. Tasks in the field of communication

The strategic management office performs the following tasks in the domain of communication:

1) plans and organises city government communication and curates the city institutions in informing the public;

2) informs the people of Tallinn of significant topics concerning city life and information related to daily life;

3) organises that Tallinn news reach the people of Tallinn via the city’s media channels;

4) develops the uniform visual identity of the city and organises the registration and use of city brands;

5) organises the award of the city medal (raemedal), Tallinn Coat of Arms and decoration;

6) participates in the formation of organisational culture and curates the city’s internal communication, incl. manages and develops the city intranet.

§ 10. Tasks in the field of digital solutions

The strategic management office performs the following tasks in the domain of digital solutions:

1) curates the planning, prioritisation and development of city information systems;

2) curates the development of innovative digital solutions that support city development and participates in innovation projects related to digital solutions;

3) ensures the functioning of public e-services, information systems, IT infrastructure and services of the city and the platform services across all institutions, and curates their development;

4) curates city data protection, incl. cyber defence;

5) ensures the functioning of the technical platform of the data analysis field and curates its development;

6) provides the service of the Tallinn base map and digital city model and conducts cartography work.

§ 11. Tasks in the field of financial management

The strategic management office performs the following tasks in the domain of financial management:

1) curates the financial administration of the city, incl. city budgeting process and finance administration and organises the finance accounting and finance reporting of the city and city institutions;

2) curates the city operations in the domain of public procurements, organises the public procurements focussing on the city and conducts supervision of following the city procurement organisation in city institutions;

3) curates the purchasing of the goods and services necessary for the operation of city institutions and the signing of payment condition agreements;

4) ensures the administration and development of the city financial information system;

5) curates support of non-profit activities and administrates the project and activity support information system of Tallinn;

6) consults the city government and institutions in matters of financial administration.

§ 12. Tasks in the field of personnel management

The strategic management office performs the following tasks in the domain of personnel management:

1) curates personnel management, accounting and reporting of city institutions and develops a uniform basis for remuneration;

2) makes proposals for improving the efficiency and effectivity of the organisation;

3) curates personnel development, performance appraisal and personnel partners system and organises personnel-centred training;

4) develops a common basis for personnel recruitment and selection and manages and organises their implementation;

5) curates a motivating work culture and the design of a healthy and safe work environment;

6) advises the managers of city institutions in personnel matters.

§ 13. Authorisations of the strategic management office

(1) The Tallinn Strategic Management Office shall have the following rights when performing tasks:

1) to submit draft legislation to city government;

2) give the city institutions and legal persons governed by private law with city’s sole shareholding mandatory instructions and tasks for work organisation and conduct supervision over their performance;

3) sign contracts with physical and legal persons;

4) form commissions and work groups involving specialists outside of the strategic management office, if necessary;

5) provide paid services and sell goods to legal and physical persons;

6) apply other authorisations granted to the strategic management office in the legislation;

7) represent the city in the order provided in legislation;

8) receive from the city institution and the legal person governed by private law the city’s sole shareholding data and documents necessary to perform its tasks.

(2) The strategic management office authorisations are implemented by the city chancellor, city directors and structural unit servants to perform the tasks in their domain, considering what is provided in the legislation.

§ 14. Structural units

(1) The strategic management centre performs its tasks via the city’s services of various domains and other structural units the aim, task and competence of which is assigned in the city legislation and statutes.

(2) The city service of a domain is a structural unit with cross-city competence that curates the performance of domain-based tasks stated in the statutes of the strategic management office according to the order provided in the city legislation, statutes and statutes of the service.

(3) The city council shall enforce the structure and completion of the service positions of the strategic management office.

 

Chapter 3

MANAGEMENT

§ 15. City chancellor

(1) The strategic management office is led by the city chancellor, who is appointed and released from service by the city government with the mayor’s proposal. The mayor assigns tasks to the city chancellor and the city chancellor shall report to the mayor.

(2) The city chancellor:

1) manages the strategic management office and ensures that its aims are reached and tasks are performed;

2) organises the conduct of the aims set by the city government and supervision of their performance;

3) organises the directing of the city development, innovation and strategic planning;

4) monitors the development and filling in of city development documents;

5) organises the preparation of analyses and forecasts necessary for city management decisions;

6) develops the public and support services of the city;

7) coordinates the actions of the city institutions in performing the tasks of local government;

8) analyses the needs for resources;

9) organises the city budget and, if necessary, the preparation and submission of its amendment proposals, budget strategy and annual report;

10) makes proposals to the mayor regarding the composition of the strategic management office tasks, structure and positions of service;

11) coordinates the activities of the structural units of the strategic management office;

12) approves the statutes of the structural units of the strategic management office and the job descriptions of the civil servants;

13) executes the rights and obligations of the employer, incl. assigns and releases civil servants and signs, amends and terminates employment contracts;

14) issues directives within its competence and supervises the performance thereof;

15) approves the operations procedure and other work order rules of the strategic management office;

16) signs contracts for performing the tasks of the strategic management office within the means assigned for the strategic management office from the city’s budget;

17) organises the possession, use and disposal of the assets given in the possession of the strategic management office;

18) organises the development of the action plans and developmental documents of the domains of the strategic management office;

19) organises the preparation of the strategic management office budget and management report, submits the budget and proposals for its amendment and, if necessary, supervises the following of the strategic management office budget and ensures that the budget is adhered to;

20) represents the city and the strategic management office within its competence and grants authorisations for representing the strategic management office and the city;

21) performs other tasks assigned to the city chancellor in the Local Government Organisation Act and statutes of the strategic management office and other legislation of the city.

(3) the city chancellor shall have the right to delegate the performance of the tasks stated in clauses 12-17 of subsection 2 of this section to the city director or another strategic management office servant.

(4) The servant to whom a task provided in subsection (3) of this section or another task is delegated which is given to the strategic management office pursuant to legislation shall have the right to issue directives within the competence delegated to them.

(5) The city chancellor shall be liable for the performance of the strategic management office tasks within the extent in which the liability for performing them is not assigned to the city director

or another structural unit head according to the statutes of the strategic management office or another city legislation. The city chancellor shall ensure the coordination of the performance of a task that is the responsibility of multiple structural units and appointment of a main responsible person.

(6) An absent city chancellor shall be substituted by a person appointed by the mayor’s directive. The city chancellor substitute shall have all the rights and obligations of the city chancellor.

§ 16. City director

(1) The city director is the head of the domains service of the city and ensures achievement of the city’s aims in the domain provided in these statutes and the performance of the tasks, following the extent and order provided in the city legislation, incl. statutes of the strategic management office, structural unit statutes and job description of the city director.

(2) The city chancellor shall submit to the mayor a city director candidate or make a proposal for releasing the city director from their duties. With the mayor’s proposal the appointment or release of city director is reviewed at the city government session and the decision is formalised as an order, pursuant to which the city chancellor shall appoint the city director or release them from their duties. For the city director, the city chancellor shall perform other rights and obligations of an employer.

(3) The city chancellor shall assign tasks to the city director. The city director shall report to the city chancellor on the matters concerning the city director’s domain.

(4) In their activities, the city director represents the city and the strategic management office.

(5) The city director shall dispose the strategic management office’s budget means in their domain within the authorisation granted by the city chancellor and shall be liable within their competence and the received authorisation for performing the tasks of the domain’s service and for the precise and smart following of the budget.

(6) The detailed rights and obligations, competence and liability of the city director shall be determined in the city legislation, structural unit statutes and job description.

 

Chapter 4

IMPLEMENTING PROVISIONS

§ 17. Performing tasks

(1) Tallinn Strategic Management Office shall perform the tasks assigned to the Tallinna Ettevõtlusamet (the entrepreneurship service).

(2) Tasks assigned to the Tallinn City Office in the city legislation before 1 January 2021 shall be performed by the strategic management office if the task is within the latter’s competence according to the statutes of the strategic management office.

§ 18. Rendering a regulation invalid

Tallinn City Council regulation No. 8 of 16 May 2019 “Tallinna Ettevõtlusameti põhimäärus” (statutes of the Tallinn entrepreneurship office) shall be rendered invalid.

§ 19. Amending the regulation

The following amendments shall be made to the Tallinn City Council regulation No. 36 of 13 June 2013 “Statutes of the Tallinn Urban Planning Department”:

1) clause 6 (1) 1) shall be amended and worded as follows:

“1) participating in the forming of a uniform strategy for spatial development and planning of the city;”;

2) clause 6 (1) 2) shall be repealed;

3) clause 6 (1) 3) shall be amended and worded as follows:

“3) organisation of activities related with design to execute the spatial development and design strategy of the city in terms of detail plans and implementing the strategy in design and construction works;”;

4) clause 6 (1) 4) shall be amended and worded as follows:

“4) organisation of design activities in terms of detail plans, excl. organisation of strategic assessment of environmental impact and signing contracts necessary for constructing buildings for public use;”;

5) clause 6 (1) 5) shall be amended and worded as follows:

“5) determining the terms of protection and use of built-up areas of cultural and environmental value in detail plans, design conditions and construction projects, organisation of preservation, protection and supervision;”;

6) clause 6 (1) 10) shall be repealed.

§ 20. Enforcing the ruling

The ruling is enforced on 1 January 2021.
